The Abu Dhabi Family, Civil, and Administrative Cases Court has mandated that a woman must pay her sister Dhs340,000, along with a penalty of Dhs20,000. This decision follows the woman’s inability to repay a loan she received from her sister.
The plaintiff sister initiated legal action against the defendant, seeking a court order for the repayment of Dhs340,000, plus legal and late interest at a rate of 9% from the filing date. Additionally, she requested Dhs200,000 as compensation for both material and moral losses, with legal and late interest at a rate of 5% from when the judgment is finalized until full payment. She also sought coverage for all court-related costs and expenses.
The court ruled that the defendant must cover all associated court fees and expenses.
The complaint was based on the premise that the defendant had borrowed Dhs540,000 from the plaintiff. The plaintiff transferred the sum in two parts: Dhs500,000 initially, followed by Dhs40,000. The defendant partially repaid Dhs200,000. At various points, the defendant acknowledged her debt to the plaintiff through their communication. She expressed her readiness to issue a guarantee check and suggested paying in installments. Furthermore, she confirmed her debt while proposing to resolve the issue by renouncing her share of an inheritance in favor of her sister.
The court clarified that the defendant acknowledged receiving the specified amount from the complainant. This is further substantiated by her action of issuing a manager’s check as a guarantee for the debt. When questioned about the reason for issuing the check, she stated it was to settle the dispute without providing further justification. Consequently, the court ordered her to pay the complainant Dhs340,000, along with a fine of Dhs20,000, to compensate for the lost benefits from the claimed amount and for both material and moral damages.
