
Abu Dhabi Family, Civil and Administrative Cases Court ordered a man to pay a woman Dhs72,500, including Dhs70,000 he fraudulently seized, and Dhs2,500 as compensation for the material and moral damages she incurred, in addition to obliging him to pay fees and expenses.
In detail, a woman filed a lawsuit against a man, demanding that he be obligated to pay Dhs80,000, including Dhs70,000 which he seized from her without legal right, and Dhs10,000 as compensation for the material and moral damages she suffered as a result of his actions, in addition to legal interest at 12% annually from the date of filing the lawsuit until full payment.
The woman pleaded that the suspect seized Dhs70,000 of her money using fraudulent means, which prompted her to file a report with the police.
The incident was referred to the Public Prosecution, where a criminal judgment of one year imprisonment was issued against him, which was upheld on appeal and became final after no appeal was filed with the Court of Cassation.
The court clarified in the reasoning of its judgment that the final criminal judgment proved the charge, and it was established from the case documents and investigation reports that the appellee seized Dhs70,000 without legal justification, which necessitates obliging him to return the amount to the plaintiff.
The court also found that the appellee caused the woman material and moral damages and ruled to compensate her with Dhs2,500 for those damages and rejected the request for legal interest and the request to include the judgment in immediate enforcement, and obliged the appellee to pay fees and expenses.
