Al Ain court orders man to pay bank Dhs255,665

Al Ain Civil, Commercial, and Administrative Cases Court ordered a bank client to pay Dhs255,665 to a bank from which he had obtained banking facilities through Murabaha, according to the terms and conditions of the Murabaha contract concluded between the two parties.

Allegedly, the client had failed to pay the monthly installments and breached his contractual obligations, so the bank filed a lawsuit against him, requesting a judgment obliging him to pay Dhs257,128, the remaining value of the facilities granted to him, in addition to obliging him to pay fees, expenses, and legal attorney fees.

The bank pleaded that the appellee breached his contractual obligations and failed to pay the installments and amounts due from him, and the claimed amount was recorded as dues, despite being asked to pay what he owed, but he refused.

The court clarified that it was evident from the case documents and papers, and from the report of the appointed consulting banking expert by the bank, that the customer obtained banking facilities under a Murabaha contract for a vehicle, and that the original facility amount was Dhs340,000, the agreed-upon profits were Dhs52,530, and the total facility amount was Dhs392,530, to be paid in installments, after the bank obtained guarantees consisting of a mortgage on the vehicle in favour of the bank and an undated cheque of Dhs408,000.

The court added that the client paid only Dhs138,125, then stopped paying, and after calculating agreed-upon late payment penalties of Dhs1,260, he was ordered to pay the bank Dhs255,665.
