
Al Ain Civil, Commercial and Administrative Cases Court obligated a man to pay Dhs55,600 to a woman after she transferred the amount to him in installments to book travel tickets and make hotel reservations for the people accompanying her but he failed to fulfill his obligations.
Earlier, the woman filed a lawsuit against a man in which she requested the court to obligate him to pay her the aforementioned amount as well as the incurred fees and expenses.
She pleaded that she had transferred the amount to the defendant in three installments on the condition that the latter would book travel tickets and make hotel reservations for the people accompanying her, but he failed to do so and did not return the amount to her to date, which prompted her to file the lawsuit with the aforementioned requests.
The appointed expert concluded that the defendant did not provide evidence of his fulfillment of his obligations, as he did not book the travel tickets and did not arrange for accommodation requested by the plaintiff despite receiving the needed money to do so.
The defendant did not return the money to the plaintiff either and promised in the WhatsApp messages attributed to him from his phone number that he would pay her, but he did not provide any evidence that he returned the amounts transferred to his personal bank account.
The court explained that it was established from the report of the appointed expert that the defendant owed Dhs55,600 to the plaintiff and that he failed to fulfill his contractual obligations.
Based on this, the defendant was liable for the same amount, especially since he neither appeared in person or through a representative to defend the claim, nor proved to the court that he was innocent of the debt, the court added.
