Abu Dhabi Family, Civil and Administrative Cases Court ordered a woman to pay Dhs225,000 and fined her Dhs10,000 as compensation to a man who had filed a lawsuit against her, in which he requested that she be required to pay him Dhs225,000, plus Dhs20,000 in compensation, and a legal interest of 5% annually from the date of claim until full payment, as well as fees, expenses, and attorney’s fees.
The complainant filed his lawsuit on the grounds that the woman, due to her financial distress, asked him to lend her an amount, so he transferred Dhs225,000 to her account in two installments: the first was Dhs150,000 and the second Dhs75,000.
The woman allegedly acknowledged receiving the amount and undertook to repay it, according to what was established from exchanged chats via an electronic application, but she refused to pay despite repeated demands. However, she did not respond, causing him material and moral damages.
The court explained that what was established from the case papers and the documents and electronic conversations exchanged between the two parties was that the woman acknowledged the debt and admitted to paying the amount subject to the claim, but she did not provide proof of that or that her liability had been cleared.
The court concluded that the debt was proved and that the woman’s liability was occupied by the amount of Dhs225,000 in favour of the plaintiff, so it ordered her to pay him the amount, and to pay Dhs10,000 in compensation for the material and moral damages he incurred.
